1. Introduction

Welcome to MobiMarket, an online platform that connects buyers and sellers of new and used phones. By accessing or using our platform, you agree to comply with these Terms and Conditions. If you disagree with any part of these terms, you may not access the service.

2. Definitions

For the purposes of these Terms and Conditions, the following terms have the meaning assigned to them below:

• Platform: the MobiMarket website and all its associated services
• User: any person who accesses or uses the Platform
• Seller: User who posts listings for the sale of phones
• Buyer: User who expresses interest in purchasing phones through the Platform
• Listing: post made by a Seller on the Platform to offer a phone for sale
• Content: all information, texts, images, videos and other materials published on the Platform

3. User Registration

To use certain features of the Platform, you must create an account. You are responsible for maintaining the confidentiality of your login credentials.

Registration requirements

• Be over 18 years old or have parental authorization
• Provide true, accurate and complete information
• Keep account information up to date
• Do not create multiple accounts without authorization

Account responsibility

You are solely responsible for all activities that occur on your account. In case of unauthorized use, you must immediately notify MobiMarket.

4. Listing Rules

Listings published on the Platform must comply with the following rules:

Prohibited content

• Listings of illegal, counterfeit or stolen products
• Offensive, discriminatory or hate speech content
• False or misleading information about the product
• Photos that do not match the advertised product
• Any content that violates intellectual property rights

Truthfulness of information

The seller is solely responsible for the truthfulness of the information contained in their listings, including description, photos and condition of the product.

5. Purchases and Transactions

MobiMarket acts as an intermediation platform between buyers and sellers. We do not make sales directly and are not party to the transactions.

Role of the platform

We provide the infrastructure for buyers and sellers to connect, but we are not responsible for negotiations, payments or deliveries made between users.

Transaction responsibility

We recommend that buyers and sellers establish clear terms for their transactions, including payment method, delivery time and return conditions.

6. Limitation of Liability

MobiMarket shall not be liable for:

• Direct or indirect damages arising from the use or inability to use the Platform
• Transactions between users, including problems with payment, delivery or product quality
• Content posted by third parties that violates rights or is considered offensive

7. Competent Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Belgium.

Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the Courts of Arlon, Belgium.

The parties elect the forum of Arlon as the only competent court to resolve any issues arising from these Terms, with express waiver of any other, however privileged it may be.

8. Privacy and Data

Use of the Platform is subject to our Privacy Policy, which describes how we collect, use and protect your personal information.

By using MobiMarket, you consent to the processing of your data as described in the Privacy Policy.

9. Changes to Terms
